12:00 p.m. Part I: The Ethical Edge - Do you have to look and, if you do, do you have to tell?

Modern eDiscovery practice, especially technology-driven review, is fraught with novel ethical pitfalls that are often overlooked. Our panelists will look through the lens of FRCP 26(g) to tackle some of the toughest ethical concerns that lie just below the surface of today's approach to eDiscovery from collection through production.

12:50 p.m. Part 2:The Ethics Inferno - Move up and to the right!

This session, in the form of a fun interactive game, will test your knowledge of legal ethics’ rules surrounding eDiscovery protocols and technology. The panel will walk you through the decisions that are made in a model case where the Defendant elected to utilize Technology-Assisted Review. Try to get enough answers right to ascend to “Ethical Paradise” — but beware — too many incorrect answers could land you in the “Ethical Inferno!”
